con ex o judicial independence.
A close look a hese ques ions e eals he complexi y o judicial independence, which is a sig-
nifican challenge o concep ualizing his p inciple. This becomes pa icula ly clea when one akes
in o accoun ecen empi ical findings, which we e no ye a ailable when he legal p inciple was
ini ially shaped especially by cons i u ional and egional human igh s ju isp udence. Such de el-
opmen s conce n insigh s in o he ac o s ha con ibu e o no ma i ely undesi able beha iou as
well as in o human cogni ion in gene al. I also ela es o he pe cep ion o judicial decision-making
by he add essees o judicial decision-making. An unde s anding o he p inciple o judicial inde-
pendence ha is based on an o e simplified idea o judicial decision-making does no do jus ice o

ha minimize he isk o beha iou ha is no in line wi h judicial independence.
This fi s le el is, howe e , no he only phase o he judicial beha iou ha should be aken in o
accoun o judicial independence. On a second le el, he implemen a ion le el, judges ansla e hei
