1. INTRODUCTION
Co up ion has long been one o he mos se ious p oblems acing he Indonesian na ion (Fauzi e al., 2023). This p ac ice no
only ha ms s a e inances bu also unde mines he legal legi imacy, public sense o jus ice, and na ional de elopmen (Handayani
& Sa agih, 2025). Va ious e o s ha e been made o e adica e co up ion, anging om he es ablishmen o special ins i u ions,
such as he Co up ion E adica ion Commission (KPK), o he c ea ion o co up ion cou s and egula o y e o m h ough he
Co up ion E adica ion Law (Fadli e al., 2022). Howe e , he eali y is ha co up ion s ill occu s sys ema ically, in ol es powe ul
ac o s, and in ec s almos all le els o he bu eauc acy and s a e ins i u ions (Hidaya e al., 2024). This si ua ion aises signi ican
ques ions abou he e ec i eness o exis ing law en o cemen .
The dominan legal pa adigm in Indonesia emains based on a posi i is app oach ha emphasizes legal ce ain y and o mal
legali y. While p o iding a clea no ma i e basis, his app oach o en p o es un esponsi e o social dynamics, mo ali y, and
demands o subs an i e jus ice (Wi iadina a, 2015). In he con ex o co up ion e adica ion, he posi i is app oach usually
becomes apped in o mal p ocedu es, unable o pene a e he s uc u al and cul u al oo s o co up ion. As a esul , law
en o cemen p ocesses a e o en eli is , slow, and lack a signi ican de e en e ec (Sapu a & A en, 2025).

ga ne ed he a en ion o nume ous esea che s, bo h na ionally and in e na ionally. Resea ch conduc ed by Rus amaji (2015)
highligh ed he limi a ions o he posi i is ic legal pa adigm in e adica ing co up ion in Indonesia. Acco ding o him, an o ien a ion
ha places oo much emphasis on legal ce ain y o en neglec s he alue o subs an i e jus ice, which is he public's hope o a ai
ou come. The s udy emphasized he need o a mo e lexible and esponsi e legal app oach, in line wi h he idea o p og essi e law.
Meanwhile, esea ch conduc ed by Syamsudin (2021) emphasized he ole o he judicia y in adop ing p og essi e legal
p inciples, pa icula ly in sen encing cases in ol ing co up ion. They ound ha se e al co up ion cou decisions ha e begun o

In e na ional esea ch also shows a simila end. Johnson (2024) in his s udy on al e na i e app oaches o law en o cemen
o co up ion in de eloping coun ies, emphasized he impo ance o mo ali y, legal cul u e, and ins i u ional inno a ion in building
an e ec i e an i-co up ion sys em. This s udy ein o ces he idea ha success ul co up ion e adica ion depends no only on legal
ex s bu also on he legal sys em's abili y o adap o social eali ies.
In Indonesia, a s udy by Yusni a (2025) links explici ly Sa jip o Raha djo's ideas abou p og essi e law o he p ac ice o
co up ion e adica ion. They a gue ha p og essi e law can se e as a ans o ma ional s a egy because i p io i izes he public
in e es . Wi h his app oach, co up ion e adica ion is expec ed o become no me ely a igid legal e o bu also a mo al and social
mo emen in ol ing public pa icipa ion.
F om hese a ious s udies, a g owing academic awa eness o he impo ance o he p og essi e legal pa adigm in add essing
weaknesses in an i-co up ion law en o cemen in Indonesia is e iden . Howe e , esea ch ha examines he concep o p og essi e
law in dep h o o mula e a s a egy o ans o ming he an i-co up ion legal sys em is s ill ela i ely limi ed. The e o e, his s udy
seeks o ill his gap by p o iding a concep ual analysis and p ac ical sugges ions o he applica ion o p og essi e law in he con ex
o e adica ing co up ion in Indonesia.
Thus, he s udy o he applica ion o he p og essi e legal pa adigm as a s a egy o ans o ming an i-co up ion law
en o cemen in Indonesia is ele an and essen ial. I se es no only as a heo e ical con ibu ion o he de elopmen o legal science

2. METHODOLOGY
This esea ch employs a no ma i e ju idical app oach, ocusing on he analysis o he concep o p og essi e law as a s a egy
o ans o ming an i-co up ion law en o cemen in Indonesia. This app oach was chosen because he p ima y ocus o he esea ch
lies in he concep ual s udy, p inciples, and legal no ms ela ed o he e adica ion o co up ion, as well as hei ele ance o he
p og essi e legal ideas de eloped by Sa jip o Raha djo. In no ma i e ju idical esea ch, law is unde s ood as a li ing no m wi hin
socie y; he e o e, he analysis is no limi ed o he ex o he legisla ion, bu also encompasses he alues, mo ali y, and spi i o
jus ice ha unde lie i .
The da a sou ces o his esea ch include p ima y legal ma e ials, such as laws and egula ions ela ed o he e adica ion o
co up ion, including Law Numbe 31 o 1999, in conjunc ion wi h Law Numbe 20 o 2001 conce ning he E adica ion o
Co up ion, and hei implemen ing egula ions. Fu he mo e, cou decisions, pa icula ly hose issued by he Co up ion Cou and
he Sup eme Cou , a e analyzed o de e mine how he p og essi e legal pa adigm is implemen ed in p ac ice. Seconda y legal
ma e ials we e ob ained om na ional and in e na ional li e a u e, books, and scien i ic jou nals ha discuss p og essi e law and
he e adica ion o co up ion o e he pas decade. Meanwhile, e ia y legal ma e ials, including legal dic iona ies, encyclopedias,
and media a icles, we e used o complemen unde s anding and s eng hen he analysis.
The analy ical me hod employed was a desc ip i e-analy ical app oach wi h a quali a i e o ien a ion. The analysis was
conduc ed h ough an in-dep h e iew o egula ions, legal doc ine, and cou decisions, hen linked o p og essi e legal heo y.
Using his me hod, he esea ch seeks no only o explain how posi i e law applies in he con ex o co up ion e adica ion bu also
o c i ique i s limi a ions and o e a p og essi e pe spec i e as an al e na i e. The quali a i e analysis was conduc ed sys ema ically
h ough in e p e a ion, legal easoning, and a gumen a i e cons uc ion, aimed a o mula ing a s a egy o ans o ming an i-
co up ion law en o cemen wi hin a p og essi e legal pa adigm. Thus, his esea ch me hodology is expec ed o p o ide a
comp ehensi e unde s anding o he ele ance o p og essi e law in e adica ing co up ion, while also gene a ing heo e ical and
p ac ical ecommenda ions ha can con ibu e o s eng hening he na ional legal sys em.
3. RESULTS AND DISCUSSION
3.1 The Cu en S a e o An i-Co up ion Law En o cemen in Indonesia
An i-co up ion law en o cemen in Indonesia con inues o ace signi ican challenges, despi e no able p og ess in ins i u ional
and egula o y de elopmen . The p esence o he Co up ion E adica ion Commission (KPK), he es ablishmen o he Co up ion
Cou (Tipiko ), and s ingen laws and egula ions should be c ucial in e adica ing co up ion (Zaid e al., 2023). Howe e , in
p ac ice, co up ion emains widesp ead, s uc u ed, and in ol es a ious laye s o he bu eauc acy and poli ical ac o s.
One undamen al p oblem is he high numbe o co up ion cases unco e ed yea a e yea . Da a om T anspa ency

An i-co up ion ins i u ions also ace complex dynamics. The Co up ion E adica ion Commission (KPK), once conside ed
he mos e ec i e ins i u ion in e adica ing co up ion, has ecen ly been weakened by he 2019 e ision o he KPK Law, which
changed i s s a us o an ins i u ion unde he execu i e b anch (P ase io, 2021). This change has gi en ise o c i icism ha he KPK's
independence has diminished, cas ing doub on i s e ec i eness in handling majo co up ion cases (La i & Ramadani, 2024).
Fu he mo e, limi ed human esou ces, budge cons ain s, and a hea y wo kload also impac he pe o mance o law en o cemen
agencies.
On he o he hand, he public's legal cul u e s ill displays an ambi alen a i ude owa d co up ion. On he one hand, co up ion
is conside ed a common enemy; Howe e , on he o he hand, he p ac ices o g a , nepo ism, and abuse o powe a e s ill ega ded
as usual in some ci cles. This si ua ion ein o ces he a gumen ha e adica ing co up ion canno ely solely on a no ma i e-
posi i is ic app oach bu equi es a ans o ma ion o he legal sys em capable o changing he pa adigm, beha io , and mo ali y o
bo h o icials and he public (Guna o e al., 2022).
Thus, he ac ual s a e o an i-co up ion law en o cemen in Indonesia e lec s a gap be ween ideal legal no ms and ac ual legal
p ac ice. Regula ions and ins i u ions a e in place, bu hei e ec i eness alls sho o expec a ions. This si ua ion highligh s he
need o a new pa adigm in comba ing co up ion, one ha emphasizes a p og essi e legal app oach cen e ed on subs an i e jus ice,
mo al cou age, and he in e es s o he people.
3.2 P og essi e Legal Pa adigm in he Con ex o An i-Co up ion Law En o cemen
The p og essi e legal pa adigm is a legal concep de eloped by Sa jip o Raha djo as a c i ique o he dominance o posi i is
law, which has long been he p ima y ounda ion o law en o cemen p ac ices in Indonesia (Hamid & Rusmawan, 2023).

achie e g ea e goals, namely, subs an i e jus ice, humani y, and he wel a e o he people (Nu ohim, 2025). F om his pe spec i e,
law is iewed as a dynamic ins umen ha cons an ly e ol es in esponse o socie al changes, no simply a o mal ule ha limi s
he ac ions o law en o cemen o icials.

a eal de e en e ec (Wan u & Puluhulawa, 2023). The p og essi e pa adigm ins ead emphasizes he cou age o law en o cemen
o make b eak h oughs, whe he in in e p e ing laws, imposing sanc ions, o building a sys em ha be e suppo s he public in e es .

a clean and in eg a ed legal sys em.
The p og essi e legal pa adigm also emphasizes he impo ance o mo ali y in legal p ac ice. E adica ing co up ion canno be
iewed solely as a legal issue, bu also as a ma e o na ional e hics and mo ali y. The e o e, an i-co up ion law en o cemen mus
be di ec ed a building in eg i y, ins illing an an i-co up ion cul u e, and encou aging beha io al change a bo h he indi idual and
ins i u ional le els (Faha uddin & Hakim, 2023). In his ega d, p og essi e law exis s no me ely as a no ma i e ool, bu as an

e adica e co up ion can genuinely mee he public's expec a ions o jus ice.

o he posi i is pa adigm ha has domina ed legal p ac ice in Indonesia. Legal posi i ism ends o place law solely wi hin no ma i e
and p ocedu al ex s, o en ailing o add ess he need o subs an i e jus ice wi hin socie y (Nu din & Tu die , 2021). The e o e,
p og essi e law eme ged o encou age changes in pe spec i es, mindse s, and legal p ac ices ha a e mo e adap i e, humanis ic,
and esponsi e o he needs o he people.
As a ans o ma ional s a egy, p og essi e law emphasizes he impo ance o law en o cemen o ice s' cou age o o e come
o malis ic cons ain s. In he con ex o e adica ing co up ion, his s a egy plays a c ucial ole because co up ion is an
ex ao dina y c ime ha canno be elimina ed h ough con en ional means. Co up ion has complex s uc u al, cul u al, and poli ical
dimensions, necessi a ing a mo e comp ehensi e and isiona y app oach o law en o cemen (Muhammad & Mu yan o, 2023).
Based on p og essi e law, law en o cemen is encou aged o make b eak h oughs, bo h h ough con ex ual legal in e p e a ion and
upholding mo al p inciples in sen encing, while also ha ing he cou age o ake ac ion agains any pe pe a o wi hou
disc imina ion. This s a egy aims o es o e he digni y o he law as an ins umen o jus ice and s eng hen public us , which he
weak in eg i y o law en o cemen agencies has o en e oded.

p io i izing openness, anspa ency, and accoun abili y, p og essi e law os e s collabo a ion among law en o cemen o icials, he
go e nmen , and ci il socie y, making co up ion e adica ion s a egies mo e e ec i e and deeply oo ed in public consciousness.
In addi ion o ins i u ional aspec s and legal cul u e, he p og essi e legal ans o ma ion s a egy also encompasses egula o y
e o m. Exis ing egula ions ha e emphasized a ep essi e app oach, ocusing on c iminaliza ion, whe eas e adica ing co up ion
equi es a combina ion o en o cemen and p e en ion. Th ough a p og essi e legal pe spec i e, egula ions can be di ec ed no only
o punish pe pe a o s bu also o s eng hen mechanisms o eco e ing s a e losses, encou age ea ly an i-co up ion educa ion, and

3.4 Implica ions
The implica ions o implemen ing a p og essi e legal pa adigm o an i-co up ion law en o cemen in Indonesia a e a -
eaching, encompassing ins i u ions, egula ions, and he b oade legal cul u e o socie y. This pa adigm shi s he legal o ien a ion
om me e o mal ce ain y o achie ing subs an i e jus ice and social wel a e (Maolani, 2024). Thus, he law is no longe iewed

economic, and poli ical s uc u es.
