4.1. Na u e o Ma i ime Ca ie Liabili y:
Ma i ime ca ie liabili y is con ac ual and a ises om he ca ie ’s b each o obliga ions owa d he con ac ing

Thus, ca ie liabili y is ounded on a p esump ion o aul , which is a simple p esump ion. The ca ie is equi ed

In such cases, he ca ie canno exone a e hemsel es om liabili y i he cause o damage emains unknown.
As a gene al ule, ca ie liabili y encompasses o al loss, pa ial loss, damage, and delay, as ollows:
A. To al Loss:
To al loss occu s when he ca ie is unable o deli e he goods o he consignee a he po o des ina ion, and i
is impossible o loca e hem elsewhe e o deli e y. To al loss does no necessa ily equi e he physical des uc ion o

B. Pa ial Loss:
Pa ial loss, also called sho age, occu s when a po ion o he goods is missing, p o ided i is no due o he inhe en

C. Damage:

The ca ie may de end agains claims o damage using any legally ecognized means o p oo

D. Delay:
The ca ie is liable o losses a ising om delay in ul illing con ac ual obliga ions, unless he delay is caused by a

Delay compensa ion applies only o he undes oyed po ion o goods in cases o pa ial loss and canno exceed he
