FROM THE EDITORS RIGHT AND TRANSHUMANISM FACING FRONT The transhumanist movement is much more than a mere utopia, a new current of thought or a fashionable ideology; in fact, as Luc Ferry affirms, it is a scientific-philosophical project that is already underway and that defends the use of the most advanced emerging technologies, from emerging technologies (NBIC) - nanotechnology, biogenetics, information technology and cognitive-science, to robotics and Artificial Intelligence. Through these emerging technologies, the transhumanist project aims to exponentially increase the physical, cognitive, sensory, moral and emotional capacities of human beings. Transhumanism supposes, on the other hand, a change in the anthropocentric paradigm defended by humanism, and seeks to overflow the limits of nature that until recently we considered insurmountable to create a new species more evolved than that of Homo sapiens: Homo excelsior, a posthuman species superior to ours, formed by gifted beings that have been selected, designed and genetically improved that, according to the transhumanist imaginary, will dominate the posthuman future and will be happier, more virtuous, longer-lived and more intelligent than we

In this issue of Ius et Scientia (1/2019) it is proposed, from the plural and interdisciplinary perspective of the eleven scientific articles that integrate it, technological humanism is proposed as an intermediate formula in the doctrinal debate between bioprogressive and bioconservative iusfilosofos, so that the development of scientific research and the advancement of new technologies are possible, although never at the cost of the sacrifice of dignity and freedom, which are inherent qualities of the human being (which must be conceived, in Kantian terms, as an end in itself). In the first article, Simona Fanni focuses her study on human health and vulnerability in the era of anthropocene and transhumanism, in particular, part of a perspective from the perspective of human rights and analyzes the solutions adopted in the context of the European Union and the Council of Europe to ensure more effective and fair access to healthcare. This approach, which is international in scope, takes into account the jurisprudence of the Court of Justice of the European Union and the European Court of Human Rights. Within this European legal and jurisprudential framework, the author believes that it is possible to advance the effectiveness of the right to health care better and fairer through the opportunities that open up in the field of scientificbiotechnological research, pharmacogenetics or pharmacogenomics. , gene therapy and regenerative medicine.

In the second article, Patricia Craviotto proposes an approach to the scientific and ethical doctrinal debate that exists in relation to surplus embryos in assisted reproduction techniques and, especially, in relation to preimplantation genetic diagnosis (PGD). The dilemma is frequently raised to those parents who wish to avoid the transmission of hereditary diseases, and who are offered PGD, which consists in the diagnosis of genetic and chromatic alterations in embryos, before their implantation, for to ensure that children are born free from inherited diseases. The PGD technique makes it possible to isolate embryos in the octocellular stage in a preventive test in which, if necessary, the embryo examined in the test tube would not be implanted again, so that the mother would be prevented from interrupting her pregnancy which, otherwise, would have to be applied after the prenatal diagnosis. Another reason for controversy that arose among scientists, theologians and philosophers is that raised around transhumanist techniques, which allow the generation of embryos with the DNA of three different people in order to avoid mitochondrial diseases. The purpose of this transhumanist technique, which continues to be a manipulation of embryos, is to prevent genetic mutations from being transmitted to children using a person's DNA so that the child is born healthy. In the third article, Ana Cristina Gallego Hernández brings us closer to the ethicaljuridical problematic arising from the biological experiments with human beings

Este debate está llegando a un punto álgido especialmente con respecto a los llamados ciborg-atletas (deportistas que han sido mejorados con implantes o prótesis que les permiten no solo competir, sino llegar a convertirse incluso en plusmarquistas mundiales). in the framework of the Law that regulates armed conflicts: fundamentally, it would be the Geneva Conventions, which in general prohibit scientific and biological experimentation with human beings, except in the case that they are medically justified in order to alleviate the suffering of patients who are being treated and receiving health care in accordance with the law. In the fourth article, Silvia Irene Verdugo Guzmán puts us before the ethical-legal dilemmas raised in the world of sport with regard to the development of emerging technologies, and in particular of biogenetics and genetic engineering for the sake of improving performance sports athletes, even in many cases going beyond the limits of human nature. This debate is reaching a high point especially with regard to the so-called cyborg-athletes (athletes who have been improved with implants or prostheses that allow them not only to compete, but to become even world record holders). In the fifth article, Karla Fernández Munaylla and Jorge Rodríguez Figueroa, submit to study a case of flagrant violation of the right to health due to pollution caused by companies emitting toxic waste such as lead in the Ventanilla District 2017 (Peru). It is a serious case of an attack against the health of the population of said district, and especially of the most vulnerable groups, children, women and the elderly living in the lathe of said companies. Pollution of the environment and violation of the right to health continues to occur daily in this Peruvian population center, as can be seen from the data provided by the authors of this

In the sixth article, Juan Esteban Cárcar Benito focuses on the study of the ethical, legal, social and technical problems posed by the use of brain implants performed with advanced neurosurgery techniques, for the sake of a supposed therapeutic use that sometimes seems that It responds more to the paradigm of the improvement medicine that defends technological transhumanism (or posthumanism). These invasive practices violate human dignity, the unavailability and inviolability of the integrity of the patient and, therefore, make it necessary to open a process of reflection that serves to challenge the jurists and subject to regulation the indiscriminate and unlimited use of these implants. In the seventh article, Nicolás Carrillo Santarelli exhorts, for the sake of the preservation of dignity and human rights, scientists and jurists to achieve a balance between the scientific development of emerging technologies NBIC, Artificial Intelligence and robotics, and a timely (and consistent) international regulation (still in the embryonic phase). In the eighth article, Ramón Valdivia Giménez makes a critique from the perspective of Christian theology to the post-humanist paradigm that seeks the moral, intellectual and physical improvement of the human being to the point of eradicating the imperfection that is inherent to it in its commitment to generation of a posthuman species: the one that corresponds to Homo excelsior.

En el noveno artículo, Francesco de Vanna dedica su estudio a ponderar el Certainly, in this new biotechnological and digital era the humanist paradigm is gradually being replaced - which considers the individual as an end in itself and defends the sacredness of the human condition and the dignity of people as moral subjects (whose freedom is inviolable and unavailable) - by the posthumanist paradigm that, in its more utilitarian version, proposes the overcoming of natural limits by artificial means for the organic and intellectual perfection of the human species, and even places the omnipotent Homo excelsior above the fallible Homo patiens and even the imperfect Homo sapiens. In the ninth article, Francesco de Vanna dedicates his study to ponder the role of NGOs in the migration horizon, specifically in the space of the common borders of the European Union. In this sense, the task of locating, rescuing and assisting migrants who, due to the situation of vulnerability with which they embark on their journey to the continent, are in danger of being shipwrecked on the high seas before reaching the European coast, or They try desperately to cross borders in painful illegal transports that put their lives in danger, they show the inefficiency and the overflow of the member states in the management of humanitarian crises like those of the years 2015 and 2017. In this sense, the extraordinary work The humanitarianpolitical initiatives being carried out by the host NGOs (such as Open Arms) highlight the need to establish a fairer and more efficient immigration policy in Europe.

In the tenth article, María Leonor Quicaña Chappa and Jorge Rodríguez Figueroa devote their joint study to a subject as important as environmental auditing by public administrations in order to provide the administrated with a healthy environment. In particular, this study focuses on the District Municipality of Carabayllo (Peru). Finally, in the eleventh article, Domingo Fernández Agis studies the transformation or process of revolution that contemporary society is experiencing and its implications in terms of ethics, justice, rationality and freedom. In this process of social transformation influence, in the opinion of this author, three fundamental aspects: the dissolution of the idea of responsibility of the intellectual; the fetishization of knowledge; and the concealment of the historical dimension of any social configuration. It has also been included, following the experience of the previous issue, a section of Book Review with a review of Dr. Saad Bentaouet to the book La Europa de los derechos frente a los desafíos científicos y tecnológicos, Tirant lo blanch, Valencia, 2018.
